The Senckenberg – Leibniz Institution for Biodiversity and Earth System Research (SGN) is an association under German law and its legal personality is based on grants from the state according to Sec. 22 of the German Civil Code (Bürgerliches Gesetzbuch – BGB). It was awarded the rights of a legal person by sovereign decree on 17 August 1867. According to § 28 of the currently applicable statute, the association as defined by § 26 of the BGB is represented judicially and extrajudicially by two members of the Board of Directors which must include the Director General or the Deputy Director General.

Data Protection

The protection of personal data is very important to the SGN. Therefore, the SGN collects and processes your data on this website exclusively in accordance with the European provisions of the Basic Data Protection Regulations (DSGVO) in accordance with the new Federal Data Protection (BDSG-neu) and the Telecommunications-Telemedia Data Protection Act (TDDDG) for the SGN’s association-related purposes. The SGN therefore only collects, uses, and passes on personal data if this is permitted by law, or if you give consent for the data collection.

Legal bases for data processing in accordance with the GDPR

Article 6(1)(a) and Article 7 GDPR apply to the collection of consent, Article 6(1)(b) GDPR is the legal basis for processing to implement contractual measures and to answer enquiries, and Article 6(1)(c) GDPR is the legal basis for processing to fulfil legal obligations. Processing to fulfil legal obligations is carried out in accordance with Article 6(1)(c) GDPR. The legal basis for processing to protect Senckenberg's legitimate interests is Article 6(1)(f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR applies.

Cooperation with processors and third parties

If we disclose data to other persons and companies (processors or third parties) as part of our processing, transmit them to them or otherwise grant them access to the data, this is only done on the basis of a legal permission (e.g. if a transfer of the data to third parties, such as to payment service providers, is necessary for contract fulfilment according to Art. 6 (1) (b) GDPR), you have consented to this, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).
If we commission third parties with the processing of data on the basis of a so-called "contract processing contract," this is done on the basis of Art. 28 GDPR.

Contact

When contacting us (via e-mail), the user's details are processed for the purpose of processing the contact request and for the purpose of dealing with any follow-up questions in accordance with Art. 5 (1)(b) GDPR. We delete the enquiries if they are no longer required.

Transmission to third countries

If data are processed in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), this will only take place if it is done to fulfil our contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. The data will only be processed in a third country if the special requirements of Art. 44 ff. GDPR are met (officially recognised determination of an EU-comparable level of data protection or officially recognised special contractual obligations, so-called "standard contractual clauses").
In general, no data is transferred to third countries, since the servers providing this service are located at German institutions.

Personal Data

Personal data involve all information regarding your personal or factual circumstances that can be used to identify a person. This includes information such as your name, mailing address, telephone number, and e-mail address. Information that cannot be directly associated with your true identity (e.g., length of visit to a website or number of website users that cannot be associated with your IP address) do not fall in this category.

Consent and Right of Objection

You can object to the use of your data at any time without having to provide any form. Furthermore, under certain conditions, you have the right to information, correction, blocking and deletion of the data we have stored in accordance with Art. 15 ff. GDPR.

If you want to correct personal data shown in a dataset, please refer to the dataset author (contact) directly.

Furthermore, you have the right to lodge a complaint with a supervisory authority under certain conditions in accordance with Art. 77 GDPR in conjunction with § 40 BDSG-neu.

Server Logfiles / Access Data

Access to the websites of this internet presence is logged in accordance with Article 6, Paragraph 1 f of the DSGVO in conjunction with the BDSG-neu. This includes: name of the website, file name, date and time of access, transmitted data volume, browser type, the user’s operating system, referrer URL, and IP address. The data are analysed for statistical purposes and to improve the content offer. They are deleted at regular intervals. The provisions of the DDG apply.

Incorporation of third-party Services and Content

There is one third party service incorporated in our online content: Maps are shown via the map service WMTS TopPlusOpen provided by the Federal Agency for Cartography and Geodesy (BKG). This always requires that the content provider (hereafter referred to as third-party provider) records the user’s IP address, since the content cannot be transmitted to the respective user’s browser without the IP address. The IP address is therefore necessary for the display of the content. We make an effort to only offer content by providers that will use the IP address exclusively for the provision of this content. However, we have no influence over the possibility that a third-party provider may store the IP address for statistical purposes, etc.  To the extent that this is known to us, we will inform the user in this regard.

This web portal does not use any cookies for external usage (without login).

Data Protection Notice According to § 13 of the DDG

According to the provisions of the DDG, we point out that all personal data transmitted to us via this website will not be processed and stored beyond the time period required for the service provision, and not to an extent that exceeds the data volume essentially necessary for the service provision.

As far as no other license is explicitly stated, all content, images, and graphics are protected by copyright and may only be used with the written permission of the respective copyright holder.

Liability for Links

Our content includes links to third-party external web pages (e.g., Zenodo), over whose content we have no influence. To display the content, your IP address might be transmitted to the third party. The SGN cannot accept any liability for this foreign content and compliance with the data protection regulations. The content of the linked pages is always the sole responsibility of the websites’ respective content provider or operator.

Imprint

The use of contact data published in the context of the obligation to provide an imprint by third parties for the mailing of unsolicited advertisements and information materials is hereby expressly prohibited. The operator of the websites expressly reserves the right to take legal action in case of the unsolicited mailing of advertising information, e.g., by means of spam e-mails.
